Salman Khan has petitioned the Delhi High Court for protection of his personality and publicity rights. A hearing on Thursday saw the court order social media intermediaries to respond to Salman`s complaint within three days. Know everything about it.
On Thursday, a hearing was convened at the Delhi High Court in response to Salman`s demand for complete legal protection against the unlawful exploitation of his personality features. The HC directed social media intermediaries to react to and act on the complaint within three days. A detailed interim restraining order involving the other entities involved in the case will be issued soon.
Salman petitioned the court to issue orders prohibiting various known and anonymous individuals (John Does) from exploiting his name, image, voice, likeness, conversations, mannerisms, and other characteristics. The actor further claimed that several platforms and businesses have been utilising his identity without his permission, posing a risk of misleading customers and lowering his brand value. He further argued that it would do irreparable harm to his commercial and personal rights.
Salman is one of many notable personalities who have filed legal action over the exploitation of their identities on social media. Amitabh Bachchan, Aishwarya Rai Bachchan, Nagarjuna, Anil Kapoor, Abhishek Bachchan, Jr. NTR, and others have also petitioned the court to prevent exploitation.
What are personality rights?
Personality rights are an individual`s legal right to regulate the commercial and public use of their identity. They protect features that are uniquely associated with a person, such as their name, picture, likeness, voice, signature, or even trademark catchphrases, from being used without permission.
These rights are frequently divided into two branches: the Right of Publicity and the Right to Privacy. The former prevents unauthorised commercial exploitation, such as utilizing a celebrity`s image in commercials. The Right to Privacy, on the other hand, protects against violations of personal dignity, including deepfakes, manipulated photographs, falsified endorsements, and intimate doctored content.
